Under the new IT Rules 2021, digital media platforms now need a broader grievance redressal system.

On February 25, the Center issued a set of guidelines on all social media, OTT, and digital media, including Facebook, Instagram, Twitter, to drive the rush on social media platforms. A three-month deadline was also given to implement the guidelines. The deadline for that guideline is May 25. So now the social media companies used in India have to implement the new Information Technology (Mediation Guidelines and Digital Media Ethics Code) Rules 2021, all of which will be effective from today.

What are the main requirements of IT Rules 2021?

As we have already mentioned, the new IT rules for digital media platforms require the appointment of a grievance officer in 2021, who will be part of the larger grievance redressal system. And he/she is must be a resident of India. A surveillance process will be initiated through the Ministry of Electronics and Information Technology to respond to the allegations, monthly consent reports for Indian users, including retaliatory pornography, and self-regulation.

All the major social media platforms, with over 5 million users, such as Facebook, Instagram, Twitter and Koo, are classified as very large social media platforms. As of March this year, WhatsApp has more than three hundred ninety (390) million users in India. On the other hand, the number of Facebook users in India is not very low. As of January 2021, the number of Facebook users in India is Three Hundred Twenty (320) million, according to research firm Statista.

What are the requirements for a grievance redressal system?


Under the new IT Rules 2021, digital media platforms now need a broader grievance redressal system. Anodal and grievance officer will be in charge to ensure that the government's new digital rules are being observed properly. All social media platforms have to explain the mechanism to users to complain against their app and website, as well as any content on the platform. These allegations must be acknowledged within 24 hours of receipt and disposed of within 15 days from the date of receipt of the complaint.


In addition, it has been informed that any insensitive or offensive post should be deleted within 24 hours of receiving the complaint. Any government notice or court order will require immediate redress on social media and digital media platforms.

What is Chief Compliance Officer?

The new Information Technology (Intermediate Guidelines and Digital Media Ethics Code) Rules 2021 make it clear that "for the purpose of this section" "Chief Compliance Officer" means a key management staff or an important social media intermediary. Who will be a resident of India?

What if social media companies do not follow the IT Rules 2021?

This is where sub-section 1 of section 69 of the IT Rules 2021 comes into force. The new IT Rules 2021 make it clear that, 
When an arbitrator fails to comply with these rules, the provisions of sub-section (1) of section 69 of the Act shall not apply to this arbitrator. However, the mediator will be punished under the law and any law currently in force in India.  
Article 69 will be particularly applicable to digital media platforms such as Facebook, Twitter, YouTube and WhatsApp.
